1. Validity of the conditions
The deliveries, services and offers of kollektiv vier take place exclusively on the base of these terms and conditions, even if they are not expressly agreed again. When the goods or services are ordered, these terms and conditions are deemed to have been read, understood and accepted. The buyer's general terms and conditions of purchase are hereby rejected. An adjustment of the terms and conditions by kollektiv vier is possible at any time. Deviations from these terms and conditions are only effective if confirmed by kollektiv vier in writing. The kollektiv vier terms and conditions supplement the legal basis of the Swiss Code of Obligations (OR).
2. Offer and conclusion of contract
With the order the buyer enters into a binding contract. Kollektiv vier design studio GmbH accepts the order with an order confirmation. The information in sales documents (drawings, illustrations, dimensions, weights and other services) are only to be understood as guidelines and do not represent any assurance of properties unless they are expressly designated as binding in writing.
In case that one of our suppliers no longer delivers the ordered goods despite a contractual obligation and this leads to an obstacle to performance through no fault of our own, we are entitled to withdraw from the contract. In the event of withdrawal, we will inform you immediately about the unavailability and, if necessary, immediately reimburse you for any payment already provided.
3. Prices
Kollektiv vier offers in price lists and advertisements are non-binding. The prices stated in the order confirmation are decisive. These are fixed at the time of the order. The prices are given in Swiss Francs (CHF) and do not include transport costs, including VAT.
4. Delivery and performance time
Orders with delivery addresses outside of Switzerland will only be sent after the payment has been received. Delivery times may vary depending on the delivery location. Delivery times are non-binding, unless otherwise agreed in writing. The specification of certain delivery periods and delivery dates by kollektiv vier is related on correct and on time deliveries by suppliers of kollektiv vier.
5. Default in acceptance
If the buyer refuses to accept the delivery items or declares that he does not want to accept the goods, kollektiv vier can refuse to fulfill the contract and demand compensation for non-fulfillment.
6. Delivery
The orders are carefully packed by the seller and usually sent by the Swiss Post. Unless otherwise agreed, delivery will be made to the specified delivery address. The customer is responsible for ensuring that transport to the delivery address is possible. In case of any difficulties for the delivery, the customer will inform in advance. Shipping costs are on behalf of the buyer. The amount of shipping costs varies depending on the place of delivery. The shipping price depends on the order value and is specified in the shopping cart.
When goods are imported into countries outside of Switzerland, import duties may be incurred, which the customer must pay. Import duties, duties and fees are not part of the shipping costs.
7. Assumption of risk
The risk passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If the dispatch is delayed or becomes impossible through no fault of kollektiv vier, the risk is transferred to the buyer.
8. Warranty
The goods must be checked for defects immediately upon receipt. Quantity differences must be communicated in writing to a group of four within 7 days of receipt of the goods. If the defect can be traced back to improper use, storage and handling, or external interference, any warranty is void. Insignificant deviations from the warranted properties of the goods do not trigger any warranty rights. Liability for normal wear and tear as well as consumables / accessories is excluded. Warranty claims against kollektiv vier are only available to the direct buyer and are not transferable. The guarantee is limited in any case to the purchase price.
9. Returns
A return of products if the buyer needs a prior approval by kollektiv vier is at the buyer's expense and risk. The products must be returned in their original packaging. Individual productions are excluded from the return.
10. Retention of title
The delivered goods remain the property of kollektiv vier until they have been paid for in full.
11. Payment
The invoices are payable within 30 days. If the buyer is in default, then kollektiv vier are entitled to warn the buyer. From the second reminder, kollektiv vier charges a flat rate of at least CHF 10.- per reminder. For the duration of the delay, kollektiv vier is entitled at any time to withdraw from the contract, to demand the return of the delivered goods and to claim compensation for the failure of the contract.
12. Limitation of Liability
Claims for damages from impossibility of performance, from breach of contract, from negligence when concluding the contract and from tort are excluded, unless there is intentional or grossly negligent action. Any liability is limited to the purchase price. No liability is accepted for consequential damage resulting from the use of the products.
13. Copyrights
The copyrights for all works created by kollektiv vier belong to kollektiv vier. The buyer is not entitled to make changes to the works - in particular to the design or details - without the consent of kollektiv vier. The copyrights and all other rights to content, images, photos or other files on the website belong exclusively to kollektiv vier.
14. Data protection
Kollektiv vier is entitled to process the data received about the buyer with regard to the business relationships or in connection with them, regardless of whether they come from the buyer himself or from third parties, within the meaning of the Federal Data Protection Act (DSG). Personal customer data is treated confidentially and only passed on to third parties as part of the credit check.
15. Place of jurisdiction
Basel is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
